Terms and Conditions of Sale
These Terms and Conditions of Sale ("Terms") govern your use of Omni Source Pty Ltd’s website (www.omnisource.com.au) (the "Website") and your purchase of products from us. By accessing or using the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase our products.
1. Definitions
- "We," "Us," or "Our": Refers to Omni Source Pty Ltd, a business registered in Victoria, Australia with Australian Business Number (ABN) 60 675 619 011.
- "You" or "Customer": Refers to the individual or entity using the Website or purchasing products.
- "Products": Refers to the food products of everyday use offered for sale on the Website.
2. Agreement to Terms
By accessing the Website, creating an account, or placing an order, you confirm that you have read, understood, and agree to these Terms. We reserve the right to update these Terms at any time, and changes will be effective upon posting on the Website. Your continued use of the Website constitutes acceptance of the updated Terms.
3. User Responsibilities
- Account Creation: If you create an account, you are responsible for maintaining the confidentiality of your account credentials (e.g., username, password) and for all activities under your account. Notify us immediately of any unauthorized use at cs@omnisource.com.au.
- Acceptable Use: You agree not to use the Website for any unlawful purpose, to infringe on our intellectual property, or to disrupt the Website’s functionality (e.g., through hacking or transmitting viruses).
- Accuracy of Information: You must provide accurate and complete information when placing orders or creating an account.
4. Product Information and Pricing
- Product Descriptions: We strive to ensure that product descriptions, images, and specifications for our food products on the Website are accurate. However, we do not warrant that all information is error-free or complete.
- Pricing: All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable, as required by Australian law. Prices are subject to change without notice, but changes will not affect orders already placed.
- Errors: We reserve the right to correct any errors in pricing, product descriptions, or availability and to cancel or refuse orders affected by such errors. If an error affects your order, we will notify you and offer a refund or alternative.
5. Orders
- Order Placement: Placing an order constitutes an offer to purchase. We may accept or reject your order at our discretion (e.g., due to stock unavailability or suspected fraud). You will be notified if your order is rejected.
- Order Confirmation: Upon acceptance, you will receive an order confirmation via email. This does not guarantee stock availability or delivery until the order is processed.
- Cancellation by Us: We may cancel an order if products are out of stock, pricing errors occur, or for other legitimate reasons. You will be notified and refunded in full if applicable.
- Processing Time: Orders are processed within 2 working days from the date of receipt, after which they are handed over to the carrier for delivery.
6. Payment Terms
- Accepted Methods: We accept payments via Visa, Mastercard, Afterpay, and Pay by Link. All payments are processed securely through Stripe or PayPal.
- Payment Timing: Payment is charged at the time of order placement or as specified during checkout.
- GST: All prices include GST where applicable, as required by Australian tax law. GST will be itemized on your order confirmation or invoice.
7. Delivery
- Shipping: We ship within Australia via Australia Post and internationally via DHL or FedEx. Shipping options, costs, and estimated delivery times are provided at checkout. Refer to our Shipping Policy for details.
- Delivery Timeframes: Estimated delivery times are provided as a guide and are not guaranteed. Delays may occur due to factors beyond our control (e.g., carrier issues, customs delays for international orders).
- Risk and Title: Risk of loss or damage to products passes to you upon delivery. Title (ownership) transfers upon full payment and delivery.
- International Orders: For international shipments, you are responsible for any customs duties, taxes, or fees imposed by the destination country.
8. Returns and Warranties
- Australian Consumer Law (ACL): Our food products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
- Returns Process: We do not accept “change of mind” returns for food products due to health and safety regulations. For faulty, damaged, or incorrectly supplied products, refer to our Cancellation & Returns Policy for details on the returns process.
- Warranties: Our products do not come with additional manufacturer’s warranties beyond the guarantees provided under the ACL.
9. Intellectual Property
All content on the Website, including text, images, logos, and designs, is owned by or licensed to Omni Source Pty Ltd. You may not reproduce, distribute, or use this content without our prior written consent, except for personal, non-commercial use related to your purchase.
10. Limitation of Liability
- To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Website or purchase of products, including but not limited to loss of profits, data, or goodwill.
- Our liability for breaches of ACL consumer guarantees is limited, at our discretion, to replacement, repair, or refund of the product, as permitted by law.
- We are not responsible for delays, losses, or damages caused by factors beyond our control (e.g., natural disasters, carrier delays).
11. Dispute Resolution
- Informal Resolution: If you have a concern or dispute, please contact us at cs@omnisource.com.au or +61 404 99 55 44 to resolve the issue informally. We aim to respond within 5 business days.
- Formal Resolution: If the issue remains unresolved, you may refer the matter to Consumer Affairs Victoria or seek mediation through an independent body.
- Legal Action: Any unresolved disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.
